Option, booking, payment and deposit

Before booking, an option can be taken. During this period you have the opportunity to arrange flights. While the option runs, the villa is not promised to anyone else. The length of the option depends on the demand for the period and is agreed beforehand; usually it is a few days up to a week at most. If someone else wants to rent the villa during the option period, you are given 24 hours to make a final decision. After this the option lapses automatically.

A rental agreement is reached as soon as you state that you wish to book. Taking an option is, of course, not a booking.

A booking request is held for one week; within this period the down payment (25% of the rent) has to be received in the account of Kas Tribon, failing this the booking request expires. Receipt of the down payment in our account makes the booking final and constitutes your acceptance of these terms and conditions.

The balance (the remaining 75% of the rent, the deposit and the final cleaning) needs to be paid at the latest 8 weeks before departure.

If the balance is not in our account by this date, we reserve the right to cancel the agreement; no refund will be given.

The deposit is refunded within 14 days of your return, less costs and any damage that is chargeable to the tenant. In view of this, the villa is inspected together with you by the manager on arrival and departure, and the meter readings are taken at the same time.

Cancellation

In the event of cancellation the following rules apply:

• From the down payment until two months before departure, the down payment is not refunded. The remaining balance is not payable.
• From two months before departure no refund is given.

If you have to curtail your holiday during your stay, no refund is possible. We therefore advise you to take out good cancellation insurance.

Tip: also consider travel insurance with worldwide cover.

Arrival and departure

The arrival and departure times can be arranged with the landlord and the manager, depending on the arrival and departure of your flights and the arrival of the next tenants. Our manager handles the key handover on site.

Information folder

In the villa you will find an information folder with the house rules, an inventory and useful information about the island.

Included and not included in the rent

Included: gas usage, bed linen and household linen, tea and kitchen towels, bath towels and beach towels.

Not included: final cleaning; airport transfers, electricity and water usage, the cost of a grocery package, telephone costs and personal expenses.

Use of air conditioning (electricity) and water

Electricity: we advise you to use the air conditioning only when needed; so not during the day in the bedrooms, when the windows are open or when nobody is at home. Unnecessary use of the air conditioning is the main cause of high electricity consumption. Electricity costs about € 0,45 per kWh.

Because all water has to be produced from seawater, water is relatively expensive on Curaçao (about € 9,00 per m³). You are requested not to waste water. These prices are an indication only; they are set monthly by the supplier.

Car

Please park the car on the drive and not on the road.

Smoking and drugs

Life on Curaçao is largely outdoors, where smoking is possible. Smoking in the villa is strictly not allowed.

The use of drugs and/or mind-altering substances, in any form whatsoever, is strictly prohibited in and around the villa. If this is detected, a fine will be charged to the tenant.

Open fire and BBQ

It is not allowed to light open fires in or around the villa. A BBQ outside is allowed.

Pets

• 1 pet is allowed if requested in advance.
• Pets are not allowed on chairs, sofas and beds.
• The animals must be house-trained and must be walked outside the garden.

If this is not followed, we will have to charge extra costs.

Drones

Flying drones is not allowed in and around the villa or in Villapark Fontein. This follows from the rules of the villa park and is out of respect for the privacy of the neighbours.

Use of the villa

The villa is intended solely as a holiday home. The tenant must respect the customs that apply to living in upmarket residential areas on Curaçao. This means, among other things, no nuisance to neighbours of any kind and no parties or other gatherings at which more people are present than the number booked, unless you have obtained the landlord’s prior written permission. Consult the manager beforehand if in doubt. It is not allowed to let the house to people other than those listed on the booking form. If it turns out that other or more people are staying in the villa, they will be charged to the tenant at twice the rate for the whole rental period. Making photo or video recordings in or around the house for commercial purposes is not allowed without the landlord’s written consent.

Liability

The landlord can never be held liable in any form whatsoever, other than for failing to provide the villa in the booked period because of a double booking. If the landlord fails to provide the villa in the booked period, the landlord will refund the rent paid by the tenant in full, as well as any additional costs the tenant has to make for alternative accommodation. The reimbursement of these costs (which can never exceed the rent of Kas Tribon for the period in question) by the landlord to the tenant takes place after mutual consultation and by mutual agreement, and never for a longer period than the period in which the landlord fails to provide the villa. We advise you to take out good travel and cancellation insurance.

If the villa cannot be let because of damage to the villa in any form, caused for example by natural forces, fire or another calamity, the landlord will return the down payment/rent already paid as soon as possible. The landlord then has no further obligations towards the tenant.

Departure

On departure we ask you to leave our house broom clean:

• Gas hob, combi microwave and BBQ clean.
• Washing-up done, dishwasher and washing machine empty.
• Refrigerator empty.
• Waste bins empty and waste in bags in the wheelie bin.

If this is not the case, we reserve the right to charge additional cleaning costs.
